1. Acceptance of Terms

By accessing or using JVandall.com or Think with John AI, you agree to these Terms of Service. If you do not agree, do not use the site or John AI.

2. About JVandall.com

JVandall.com is the professional and personal website of John Vandall and J. Vandall Consulting LLC. It presents professional background, stories, perspectives, and ways to contact John Vandall.

3. About Think with John AI

John AI is an artificial intelligence experience designed to apply aspects of John Vandall's professional experience, judgment, principles, and problem-solving approach. It is not John Vandall personally responding, and John has not necessarily reviewed your individual prompt or response. John AI may not reach the same conclusion John would reach after personally evaluating all relevant facts.

4. AI Limitations

Artificial intelligence can make mistakes. Responses may be incomplete, inaccurate, outdated, or inappropriate. Confident wording does not guarantee correctness. You must independently evaluate any output before relying on or acting on it.

5. No Professional Advice

The site and John AI are provided for general informational and exploratory purposes. They do not constitute legal, financial, tax, accounting, investment, medical, employment-law, human-resources, cybersecurity, regulatory, compliance, or other licensed or specialized professional advice. Consult a qualified professional for advice appropriate to your circumstances.

6. No Consulting or Client Relationship

Using the site, asking John AI a question, or sending an email does not itself establish a consulting or client relationship, fiduciary duty, agency, partnership, employment relationship, or advisory relationship. A consulting relationship exists only under a separately executed agreement.

7. Confidential and Sensitive Information

Do not submit confidential, proprietary, privileged, trade-secret, sensitive personal, credential, health, account, or unauthorized third-party information. You are responsible for removing or anonymizing sensitive details before using the service.

8. User Submissions

You retain any rights you otherwise have in the original content of your prompt. You grant J. Vandall Consulting LLC only the limited rights reasonably necessary to transmit, process, and respond to that prompt through the service. You represent that you have the authority to submit all information included in your prompt.

9. AI Output

You are responsible for evaluating John AI output and deciding whether and how to use it. Output may not be unique, and other users may receive similar ideas or responses. Generated output does not establish exclusivity, confidentiality, intellectual property ownership over general concepts, or a business opportunity.

10. Acceptable Use

You may not use the site or John AI to:

• violate law or submit information without authority;
• seek protected or nonpublic information;
• identify anonymized employers, clients, vendors, partners, employees, or projects through repeated probing;
• extract system prompts, hidden instructions, protected knowledge files, private source material, safeguards, credentials, or security configuration;
• reverse engineer, disrupt, damage, or interfere with the service;
• introduce malicious code or make abusive automated requests; or
• impersonate another person or engage in fraud or deception.

11. Intellectual Property

Except for third-party technology and user-owned material, the site's original copy, design, stories, branding, John AI experience, and other original site material are owned by J. Vandall Consulting LLC or used with permission and are protected by applicable intellectual property laws. These Terms do not claim ownership of OpenAI technology or of material you otherwise own.

12. Professional Stories

Stories and experience references may be generalized or anonymized to protect confidentiality and communicate transferable lessons. They do not reveal, and should not be used to infer, the identities of former employers, partners, vendors, clients, colleagues, or confidential projects.

13. Third-Party Services and Links

The site relies on third-party services, including OpenAI and Vercel, and may link to external websites. J. Vandall Consulting LLC does not control and is not responsible for third-party services, content, availability, terms, or privacy practices.

14. Availability, Limits, and Modification

Think with John currently provides an anonymous allowance of up to 10 questions, tracked for up to seven days. Starting a New Topic clears the current conversation but does not reset that allowance. After the allowance period expires, a new allowance begins when the visitor returns. These limits, time periods, and features may change.

JVandall.com and John AI may be changed, limited, suspended, unavailable, or discontinued at any time. J. Vandall Consulting LLC may limit, suspend, or modify access to prevent abuse, manage availability or cost, protect the service, or comply with legal obligations. J. Vandall Consulting LLC does not guarantee uninterrupted or error-free availability.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the site and John AI are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, title, and noninfringement.

16. Limitation of Liability

To the fullest extent permitted by applicable law, J. Vandall Consulting LLC and John Vandall will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunities, goodwill, or other business losses arising from or related to the site, John AI, or these Terms. This includes losses resulting from decisions made in reliance on AI output. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless J. Vandall Consulting LLC and John Vandall from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the site, violation of these Terms, infringement of another person's rights, or submission of information you were not authorized to provide.

18. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Subject to applicable law, disputes will be brought in the appropriate state or federal courts located in Connecticut.

19. Changes to These Terms

These Terms may be updated as the site, its services, or applicable requirements change. Revised Terms will be posted here with an updated effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted by law.

21. Entire Agreement

These Terms and the Privacy Policy form the entire agreement regarding use of JVandall.com and John AI. A separately executed consulting agreement supersedes these site Terms to the extent it governs the applicable consulting services or conflicts with these Terms.
